After a 10 month odyssey, construction on the new Downtown Baseball Stadium will likely resume by the end of the week. The developer of Winston-Salem Dash stadium, Billy Prim, says financing arrangements for the ballpark are now complete. Winston-Salem city leaders discussed the ballpark at Monday night's city council meeting. In exchange for the city's additional financial involvement, the city will own the stadium and lease it back to Prim. The Dash stadium should be complete by March and be ready for baseball season in April.

A settlement has been reached in a class action lawsuit involving Dannon Activia and DanActive yogurt products. The lawsuit alleges that Dannon falsely advertised the health benefits of its "probiotic" yogurt and dairy products.
The company has agreed to set up a $35-million fund to reimburse consumers who bought the products. The refund program for customers who bought Activia and DanActive yogurts will pay up to $100 per customer, depending on how much yogurt each bought.

Update: Historic Bethabara park has cancelled their annual "Apple Fest" due to wet grounds because of all of the rain the past few days.
The residents of Lake Lure are planning a memorial service for Patrick Swayze, the star of "Dirty Dancing," which was filmed in their western North Carolina community. Swayze died Monday after a 20-month fight with pancreatic cancer. He was 57. The Swayze memorial service will take place tomorrow at 7pm at Firefly Cove, a housing development that was Camp Chimney Rock when "Dirty Dancing" was filmed. The memorial service is FREE. A High School football coach in Kentucky has been found NOT guilty in the heat related death of one of his players last August. Coach Jason Stinson had been charged with reckless homicide in the death of a 15-year old player. The boy collapsed during practice and passed away three days later.
A judge in Pensacola, Florida ruled that NEITHER A FLORIDA HIGH SCHOOL PRINCIPAL NOR THE SCHOOL'S ATHLETIC DIRECTOR WILL BE GOING TO JAIL FOR SAYING A BLESSING OVER A MEAL. A previous court order against praying in school was issued in 2008 as a result of an agreement with the ACLU…that barred the staff of Pace High School from praying publicly at the school. If the judge had not cleared the two men in Thursday's proceedings, they could have faced six months in jail and a five thousand dollar fine.
FYI: Both men were represented by the Christian legal rights group Liberty Counsel
The US House has approved a measure that would cut off federal funding to the liberal community activist group ACORN. A similar bill was passed by the Senate earlier this week. ACORN came under fire for questionable voter recruiting practices during Barack Obama's presidential campaign. Just recently, undercover filmmakers videotaped ACORN workers directing them on how to carry out various types of illegal activities.

Based on a DNA match, police are expected to make an arrest ‘soon’ in the death of 24-year-old Annie Le, a Yale University graduate student who was murdered last week. A news conference is scheduled for later this morning.

Today is the 10th anniversary of Hurricane Floyd that devastated Eastern North Carolina. Hurricane Floyd produced more human misery and environmental impact in North Carolina than any disaster in memory. The 15-20 inches of rain that fell across the eastern half of the state caused every river and stream to flood. There were 57 deaths in the United States directly attributed to Floyd, and flood damage estimates range near $6 billion.

A student at WSSU unseated a longtime member of the Winston-Salem City Council. 21 year old Derwin Montgomery beat Joycelyn Johnson and two other challengers for the Democratic nomination for the East Ward seat. You might want to avoid swimming or fishing in High Rock Lake? The city of Thomasville could be facing a massive fine from the federal government after millions of gallons of sewage leaked into Hamby Creek, which flows into High Rock Lake. Officials saying that this is one of the largest sewage spills in the state in over ten years. An EPA investigation continues…
For example: The sewage totals more than the Exxon Valdese Oil Spill.
The sewage leak happened between July 13th and August 4th.

Turnout expected to be low for today’s local primary. Seven of the eight seats on the Winston-Salem City Council are up for grabs. The winners of today’s primary will be on the ballot in November. Polls open until 7:30pm.
A Silver Alert has been issued for Beresford Emmanuel Kellyman of Duffer Lane. The 83-year-old from Winston-Salem has been missing from his home since Saturday. Police said Kellyman is believed to be suffering from dementia. Kellyman is described as a black male, 5 feet 9 inches tall, about 200 pounds, and last seen wearing a plaid shirt and khaki pants.

The funeral service for Elena Shapiro will be held at Noon today at Wait Chapel on the campus of Wake Forest University. Cook is a surgeon and an assistant professor at the UNC School of Medicine.

Feazel, a researcher at the University of Colorado's department of molecular, cellular and developmental biology. But Feazel said showerheads shouldn't pose a threat to most people. And while the new findings do raise questions, it's not clear if showerheads are any more germ-friendly than other places around the house, such as faucets, counters and toilets, she said. 20-year-old Winston-Salem woman was killed Friday night after her car was rear-ended by a suspected drunk driver. Elena Shapiro, a trainee with the Carolina Ballet and a graduate of the School of the Arts, was re-ended by Dr. Raymond Cook who was going about 80 mph. Shapiro was taken to the Wake Med Hospital where she later died. The Carolina Ballet's Web site said Shapiro began studying ballet at the North Carolina School of the Arts when she was 10 years old. Cook is facing numerous charges.

President Obama providing more details of his proposed healthcare reform last night during a joint session of Congress. The President did mention the ‘public option’ saying that a government-run option would provide competition for private insurers. Funding for the program would come from eliminating wasteful spending in the current healthcare system.
An emotional outburst from one congressman during the President’s speech last night . Representative Joe Wilson (a Republican from South Carolina) shouted, "You lie!" after the President said that his healthcare reform proposal would not provide free healthcare for illegal immigrants. Wilson later apologized for the outburst.

President Obama will address the nation tonight at 8pm. Topic: Healthcare reform. The president is expected to campaign for what is known as the public option -- a government-run healthcare plan which would compete with private insurers. Pace Airlines has eliminated up to two-thirds of its workforce at its maintenance operation in Winston-Salem. After weeks of not getting paid, between 100 and 200 Pace employees were let go immediately yesterday.

The station wildfire in California is more than twice the size of Sacramento. Winds are causing the station fire to spread again. Good news is that the fire north of LA is about 60% contained.
Hurricane Fred has quickly strengthened to a Category 2 storm in the Atlantic. Fred's maximum sustained winds have increased to near 105 mph. The National Hurricane Center in Miami says Fred is expected to start weakening within 24 hours.

Focus on the Family has announced a reorganization Wednesday that will eliminate 75 jobs. Focus has cut its workforce twice since September 2008. The Colorado Springs-based ministry is shutting down the creative division of its advertising department and including Love Won Out, a program aimed at homosexuals that Focus is handing over to an organization in Florida.

A pit bull that chewed the toes off of a 4-month old baby in Jacksonville, North Carolina has been euthanized, while the child's mother and her boyfriend remain in custody, charged with felony child abuse. The baby is in stable condition at Pitt County Memorial Hospital after the dog chewed the toes off his left foot Sunday night. The mother told police she was on medication and didn't hear the baby crying even though she was sleeping in the same room

Bill Hefner, a former 12-term Democratic congressman from North Carolina, Southern Baptist gospel singer and radio station owner, died of a brain aneurysm Wednesday. He was 79. An FDA test shows that either a frog or a toad was in a Florida man's soda can. The FDA test confirmed that the remains of an animal were in Fred Denegri's can of Diet Pepsi. Denegri popped the can open July 23 as he was grilling dinner outdoors in Ormond Beach, Florida. A Pepsi spokesman said the company is aware of the FDA testing and stands by its manufacturing process. Denegri said he is pretty certain the animal was in the can before he opened it.

Officials at Wake Forest University say more than 80 students are experiencing flu symptoms. Two cases of H1N1 have been confirmed. Students with flu-like symptoms are being isolated in their rooms, where food is brought to them and where they can get class lessons online.
Washing hands and using hand sanitizer are a must to help prevent the flu.

The Davie County Board of Commissioners and Board of Education held a public forum last night at the Brock Performing Arts Center to discuss the proposal of building a new Davie County high school. By 2011, county officials see the existing high school as an auxiliary campus and are now looking to build a new school in another part of the county.
The Division of Motor Vehicles shut down the license-plate agency in the West Salem Shopping Center yesterday after one of the agency's former employees was arrested on fraud charges and in the country illegally. No charges have been filed against the owners. A note on the door of the agency referred people to license-plate agencies at Parkway Plaza at 1141 Silas Creek Parkway and at 1325 E. N.C. 66 South in Kernersville. The note did not mention the investigation.

Vermont is now allowing same-sex marriages. The state legislature in Vermont passed the marriage law earlier this year and overrode a veto by Governor Jim Douglas. Previously, Vermont had allowed civil unions. Vermont is now one of six states which have voted to legalize same-sex marriage.
Firefighters in California are making ‘excellent progress’ in battling the ‘station’ fire just north of LA. The fire is now about 22% contained. Authorities say a change in the weather has helped the firefighting effort.

A new law ordering big grocery stores to stop giving away disposable plastic bags took effect on Tuesday. Grocery stores must offer paper bags made of 100% recycled paper or encourage reusable shopping bags. The law only applies to large stores on islands or peninsulas in Dare, Currituck and Hyde counties.
