One by one they emerge. Chilean rescuers continue to pull out those 33 trapped miners. The first miner (Florencio Avalos) was brought to the surface shortly after midnight last night. One of the rescued miners proclaimed, "I was with God and I was with the devil. They fought and God won." The miners have been trapped about a mile underground since August 5th. Investigators now believe that someone killed Zahra Clare Baker, the 10-year-old from Hickory who was reported missing over the weekend. During a press conference on Tuesday, Hickory Police chief Tom Adkins stating that authorities have transitioned from a missing person to a homicide investigation. Anyone with information in the case is asked to call Hickory police at 828-328-5551. (NCNN)

The ACLU it's fighting for privacy and free speech rights in a lawsuit pitting North Carolina tax collectors against Amazon.com. Lawyers for the ACLU are in federal court in Seattle today…making the case that the North Carolina Department of Revenue's effort to learn what customers bought from Amazon would violate individual’s rights. The hearing comes in a lawsuit filed by Amazon to stop the tax agency from collecting information about buyers.

The State Supreme Court ruling on Friday that school administrators are NOT required to accommodate all ‘suspended students’. A state law requires local school boards to establish at least one alternative learning program for students serving long-term suspensions.
